General Terms and Conditions for Internet Use on Board
1. You – hereinafter referred to as the "user" – and TUI Cruises GmbH, Heidenkamps 58, 20097 Hamburg, Germany – hereinafter referred to as "TUI Cruises" or "TUIC" – become contractual partners. The general terms and conditions of use govern the conditions for using the Internet access provided on board.
2. TUI Cruises offers the user the opportunity to use the on-board WLAN (Wireless Local Area Network) and thereby obtain access to the Internet for a fee. It should be noted
- a) that even with the use of state-of-the-art satellite technology, it is not possible to guarantee a permanent, interference-free connection on a cruise ship;
- b) that transmission speeds are influenced by the respective conditions (such as weather conditions, satellite position, speed of the ship) and can therefore always vary;
- c) that TUI Cruises is entitled to refuse further use of the Internet access in the event of a violation of the terms of use (hereinafter).
3. The use of the Internet on board is generally subject to a charge. TUI Cruises' own pages are excluded from this. Under certain circumstances, TUI Cruises may provide inclusive volume as part of a contractual service. Please refer to the Mein Schiff App, the My Trips portal in your browser, or internet.meinschiff.de for the current costs, which you can access free of charge at any time on board via the ship's Wi-Fi.
4. A prerequisite for using the Internet on board is a corresponding Wi-Fi-enabled device. The device must also have a compatible operating system and up-to-date software drivers and protocols. TUI Cruises has no influence on this.
5. User obligations
- a) The user is obliged to protect the services offered and used by TUI Cruises – namely Internet access – from access by unauthorized third parties. The user booking and receiving the service is responsible to TUI Cruises for the use of Internet access and may be liable under certain circumstances.
- b) The user is obliged to use the Internet access provided by TUI Cruises exclusively in compliance with and in accordance with applicable laws, regulations, or other provisions. Illegal or abusive use is expressly prohibited to the user. In particular, the user is prohibited from
- (1) to offer, store, stream, or otherwise exploit copyrighted works without permission;
- (2) disregarding the provisions of the Interstate Treaty on the Protection of Minors in the Media and the Youth Protection Act;
- (3) to disseminate or refer to information that serves to incite hatred within the meaning of Sections 130, 130a, and 131 of the German Criminal Code (StGB);
- (4) to disseminate pornographic information and content within the meaning of Section 184 of the German Criminal Code (StGB) or information and content that is likely to seriously endanger the morals of children or young people or impair their well-being, or to refer to such information and content;
- (5) transmitting other information with illegal or immoral content or referring to such content;
- (6) to send unsolicited information, in particular unwanted or unsolicited advertising, regardless of the type of transmission ("spamming");
- (7) to contact other persons unlawfully within the meaning of Section 238 of the German Criminal Code ("stalking");
- (8) accessing information or data without authorization or intruding into data processing systems and networks without authorization.
- c) It is the sole responsibility of the user
- (1) to adequately secure the end devices registered by him against data access by third parties;
- (2) to ensure encrypted transmission of the data transmitted by the customer.
6. Liability and responsibility for content
- a) In accordance with Section 7 (2) DDG and Article 4 of Regulation (EU) 2022/2065, TUI Cruises merely provides access to the use of Internet content with its "Internet on board" service.
- b) TUI Cruises is not liable for illegal actions by third-party guests who also use the service to the detriment of the user.
- c) The user indemnifies TUI Cruises against any claims by third parties resulting from a breach of their obligations under these general terms and conditions of use or from other illegal actions when using the Internet access provided.
- d) The user bears sole responsibility for any content transmitted by him in the course of use, regardless of its form or nature.
- e) TUI Cruises shall only be liable without limitation for damages resulting from a breach of a warranty it has assumed, for damages resulting from injury to life, limb, or health, for damages caused by TUI Cruises intentionally or through gross negligence , for fraudulently concealed defects, and in accordance with the provisions of the Product Liability Act.
- f) In the event of slightly negligent breaches of obligations, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the contractual partner regularly relies and may rely, so-called cardinal obligations, TUI Cruises' liability is limited to the amount of foreseeable damage typical for this type of contract.
- g) TUI Cruises shall not be liable beyond this. In particular, TUI Cruises shall not be liable for slightly negligent causes of damage for indirect damage, consequential damage, lost profits, or for the reimbursement of futile expenses, if and to the extent that these are indirect damage or consequential damage.
7. Final provisions
- a) These provisions are governed exclusively by German law. The place of jurisdiction is Hamburg.
- b) Should individual provisions of these general terms and conditions of use be or become invalid, the remaining provisions shall remain unaffected. In the event of an invalid provision, the user and TUI Cruises agree on a legally permissible provision that comes closest to the intended purpose of the provision to be replaced. In all other respects, the general statutory provisions shall apply.

You can contact the data protection officer by mail at the same address or by email at datenschutz@tuicruises.com .
TUI Cruises processes various data necessary for providing your Internet volume. This includes personal data such as your full name, title, username, and password, as well as data on the volume booked/used. The data on your arrival and departure, as well as the IP and MAC address of your device.
We delete this data 90 days after last use. Billing data is retained in accordance with the statutory retention periods.
This data is processed in order to provide the Internet volume you have booked and to perform the related contractual services. The legal basis for the processing of this data is the contract concluded for the provision of services in accordance with Art. 6 (1) (b) GDPR.
Your data will only be passed on to third parties within the scope of order processing. All service providers are contractually bound in accordance with legal requirements. Data will not be transferred to third parties outside the EEA.
The collection of data is necessary for the performance of the service.
If the legal requirements are met, you have the following data protection rights

- Right to rectification or erasure, Art. 17 GDPR
- Right to restriction of processing, Art. 18 GDPR
- Right to object to processing, Art. 21 GDPR

If you believe that TUI Cruises is not processing your data in accordance with the legal provisions, you also have the right to complain to a data protection supervisory authority about our processing of your personal data.
TUI Cruises would like to point out once again that although we use various technical security measures to protect the system, we cannot guarantee the security of your device when using the service. It is your responsibility to adequately protect the device you use against access by unauthorized third parties.
